These Terms of Service (“Terms”) govern your access to and use of the stickyjams.com website and your purchase of products from Sticky Jams, LLC (“Sticky Jams, LLC,” “we,” “us,” or “our”). Please read them carefully. By browsing our site, creating an account, or placing an order, you agree to be bound by these Terms.
1Acceptance of these Terms
By accessing stickyjams.com (the “Site”) or buying our products, you confirm that you accept these Terms and that you agree to comply with them. If you do not agree, you must not use the Site or purchase our products. We may update these Terms from time to time as described in Section 16.
2Eligibility & Minors
You must be at least 18 years old, or the age of majority where you live, to create an account or make a purchase on your own. Our products are designed for athletes, and we know some of our customers are minors. If you are under 18, you may use the Site and our products only with the involvement and consent of a parent or legal guardian, who agrees to these Terms on your behalf and is responsible for your activity and any purchases.
3Your Account
You may need to create an account to place an order or manage subscriptions. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. You agree to provide accurate, current, and complete information and to keep it up to date. Notify us promptly at support@stickyjams.com if you suspect any unauthorized use of your account.
4Products, “Drops,” Pricing & Availability
We sell consumer audio products and related accessories designed for athletes. Some items are released as limited “drops” or in limited quantities and may sell out or be discontinued at any time without notice. We work to display products and colors accurately, but we cannot guarantee that your device’s display reflects exact colors or details.
All prices are shown in U.S. dollars unless stated otherwise and are subject to change at any time before you place an order. We reserve the right to correct pricing or description errors, and to refuse or cancel any order containing such an error, even after an order has been confirmed.
5Orders & Order Acceptance
Your order is an offer to buy. All orders are subject to acceptance by us, and we may decline or limit any order at our discretion — for example, if a product is unavailable, if we suspect fraud, or if quantity limits apply. A confirmation email acknowledges that we received your order; a contract is formed only when we ship the product. We may cancel an order before shipment and, if we do, will refund any payment for the cancelled items.
6Subscriptions & Recurring Billing
If you sign up for a subscription or recurring plan, you authorize us (and our payment processor) to charge your payment method on a recurring basis at the then-current price until you cancel. Subscriptions renew automatically for successive billing periods. You may cancel at any time before your next billing date through your account or by emailing support@stickyjams.com; cancellation stops future charges but does not retroactively refund a period already billed unless required by law.
7Shipping & Delivery
Estimated shipping and delivery times are provided in good faith but are not guaranteed. Risk of loss and title for products pass to you upon our delivery to the carrier. We are not responsible for delays caused by carriers, customs, weather, or other events outside our control. You are responsible for providing an accurate shipping address; we are not liable for orders shipped to an address entered incorrectly.
8Returns, Refunds & Guarantee
We stand behind our products. Unless stated otherwise on a specific product or promotion, you may request a return or exchange of an eligible item within 30 days of delivery. To be eligible, items generally must be in their original condition. Certain items may be non-returnable for hygiene or safety reasons, and sale or clearance items may be final sale where noted. Refunds are issued to the original payment method after we receive and inspect the return. Shipping charges may be non-refundable. To start a return, contact support@stickyjams.com.
9Promotions & Discount Codes
Discount codes, promotions, and giveaways are subject to their own posted terms, may be limited in time and quantity, cannot be combined unless stated, have no cash value, and may be modified or withdrawn at any time. We may void promotions obtained through error, fraud, or that violate these Terms.
10Proper Use & Safety
You are responsible for complying with the rules of your league, school, team, or competition, which may restrict or prohibit audio devices during play. You assume all risk associated with using our products during athletic activity. Always follow the instructions and warnings included with your product.
11Acceptable Use
You agree not to misuse the Site, including by: violating any law; infringing our or others’ intellectual property; attempting to gain unauthorized access to the Site or its systems; introducing malware; scraping or harvesting data; reselling products without authorization; or interfering with the Site’s operation or security.
12Reviews & User Submissions
If you submit a review, photo, comment, or other content, you grant Sticky Jams, LLC a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, modify, publish, and display that content in connection with our business and marketing. You represent that the content is yours to share, is accurate, and does not violate any law or third-party right. We may remove any submission at our discretion.
13Intellectual Property
The Site and all of its content — including the Sticky Jams, LLC name and logo, text, graphics, product designs, images, and software — are owned by or licensed to us and are protected by intellectual property laws. We grant you a limited, personal, non-transferable license to access the Site for personal, non-commercial use. You may not copy, reproduce, or create derivative works from our content without our prior written permission.
14Disclaimers
The Site and products are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free. Some jurisdictions do not allow certain warranty exclusions, so some of these may not apply to you. This section does not affect any non-waivable statutory rights or manufacturer warranty expressly provided with a product.
15Limitation of Liability
To the fullest extent permitted by law, Sticky Jams, LLC and its owners, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of your use of the Site or products. Our total liability for any claim relating to the Site or a product will not exceed the amount you paid us for the product giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.
16Indemnification
You agree to indemnify and hold harmless Sticky Jams, LLC and its owners, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your misuse of the Site or products, your violation of these Terms, or your violation of any law or third-party right.
17Governing Law & Disputes
These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-law rules. Any dispute arising out of or relating to these Terms or your purchase will be resolved in the state or federal courts located in the State of New Jersey, and you consent to their jurisdiction, except where applicable law gives you the right to bring a claim elsewhere. You agree to first contact us at support@stickyjams.com so we can try to resolve the issue informally.
18Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Changes take effect when posted. Your continued use of the Site or placement of new orders after changes are posted means you accept the updated Terms.
19General
If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver of it. These Terms are the entire agreement between you and us regarding the Site and supersede any prior agreements on that subject.
